If your next door neighbour has been playing his favourite Beatles song so loud that it is interfering with your enjoyment of the latest episode of " Love Island" you may be able to stop him.
In the case of Hollywood Silver Fox Farm v Emmett, the Courts held that no one has "The absolute right to create noises upon his land, because any right which the law gives him is qualified by the condition that it must not be exercised to the nuisance of his neighbour."
Mr Emmett had fallen out with his neighbour the owners of the Hollywood Silver Fox Farm, and tried to disrupt their business of breeding silver foxes for their fur business..
Mr Emmett got his son to fire his shotgun repeatedly on the border between his land and the Hollywood Farm in the hope that the foxes would miscarry when pregnant. Foxes are extremely sensitive and nervous creatures and do not like loud noises.
The owners of the Farm sued. Mr Emmett defended on the grounds that the foxes were too sensitive and he could do what he liked on his land.
The Court said no he could not.
