What is the Small Claims Court?
Claims that are under £10,000 are dealt with by a special user friendly system called the Small claims Court. This is likely to increase!
Technically there is no such thing as a small claims court. All County Courts that deal with civil cases have a division called small claims track.
The Courts deal with a large number of matters each year and have limited resources. The object of the small claims track is to enable low value cases to be dealt with quickly and without the formal procedures of the other tracks.
The main difference is that the parties can not usually recover their legal costs. Therefore Solicitors and barristers are not usually used. The Courts do not get involved in procedural matters leading up to the hearing and the hearing or trial tends to be quick and informal.
HINT: Make sure you have as much paperwork to support your case. Do not speak when the Judge is speaking.
